Do You Need a Permit for a Portable Toilet in Kelowna, Vernon, or West Kelowna?

In most cases, you do not need a separate permit specifically for a portable toilet on private property in the Okanagan. However, there are situations where permits or approvals are required, particularly for events on public land, units placed near roads or sidewalks, and larger construction projects. Here is what the major Okanagan municipalities require.

Kelowna

Private construction sites: No separate portable toilet permit is required. Your building permit covers the requirement to provide sanitation facilities on site. WorkSafeBC regulations determine how many units you need based on your crew size.

Events on public land: You need a Special Event Permit from the City of Kelowna. The permit application asks about your washroom plan, including the number and type of portable toilets. The city may require a minimum number of units based on expected attendance. Apply through the City of Kelowna Special Events office at least 60 days before your event.

Events on private property: Generally no permit needed for the portable toilets themselves, though the event itself may require a Temporary Use Permit depending on the property zoning and scale.

Units on or near city roads or sidewalks: If a portable toilet will be placed in a road right-of-way, on a sidewalk, or in a city parking lot, you need an encroachment permit or road occupancy permit from the City of Kelowna Engineering Department.

West Kelowna

Private construction sites: Same as Kelowna — your building permit covers the sanitation requirement. No separate portable toilet permit needed.

Events: The City of West Kelowna requires a Special Event Application for events on public or city-owned property. Washroom facilities are part of the review. Apply at least 45 to 60 days in advance.

Residential use: If you are placing a portable toilet on your residential property for a renovation or septic repair, no permit is needed. The unit is considered temporary and incidental to the construction work.

Vernon

Private construction sites: No separate permit required. Your building permit and WorkSafeBC requirements govern site sanitation.

Events on public land: The City of Vernon requires a Special Event Permit. The application includes a site plan showing washroom locations. Apply through the City of Vernon Recreation and Culture department.

Units in the road right-of-way: A road use permit is required if any portable toilet will be placed within the road right-of-way or on city property.

Lake Country

Private property: No portable toilet permit required for construction or residential use.

Events: The District of Lake Country has a Special Event Application process that includes reviewing washroom plans for public events.

Peachland, Coldstream, and Penticton

General rule: These smaller municipalities follow a similar pattern. No permit is needed for portable toilets on private property. Events on public land require a special event application that includes washroom planning.

For specific requirements, contact the municipality directly. Requirements can change, and each municipality may have specific conditions based on the location and scale of your project or event.

What About Strata Properties and HOAs

Some strata complexes and homeowner associations have bylaws that restrict temporary structures on common property. If you are placing a portable toilet in a strata development for a renovation or construction project, check with your strata council first. This is not a municipal permit issue but a strata governance issue.

How Long Can You Keep a Portable Toilet on Site

There is no standard time limit for portable toilets on private property in most Okanagan municipalities. As long as the unit is being used for an active purpose (construction, event, renovation), it can remain on site.

If a unit remains on a property for an extended period with no apparent active use, the municipality could treat it as an unauthorized structure. In practice, this is rarely enforced.
